Poland to challenge EU-Mercosur agreement in court
Poland has filed a complaint with the Court of Justice of the European Union against the agreement between the EU and the countries of South America (Mercosur). This was reported to the Polish publication RMF24 by a Polish diplomat in Brussels.
According to the source, Poland is demanding the annulment of the agreement and the freezing of its provisional application.
In addition to this complaint, Poland has joined the European Parliament’s request to verify the agreement’s compliance with EU law.
It is expected that in both cases the decision of the Court of Justice of the EU will take approximately 20 months.
The Polish Minister of Agriculture and Rural Development, Stefan Krajewski, noted that the complaint to the EU Court may, but does not necessarily, block the agreement with Mercosur, since the decision on this issue is made by the European Commission.
“We are reinforcing the European Parliament’s complaint by referring to several important issues in the Polish proposal, in particular the fact that the agreement (with Mercosur — ed.) was divided into a political and a trade part,” Krajewski said recently, explaining that the trade part of the agreement falls within the competence of the European Commission, while Poland believes that the decision should be made by the EU Council, i.e. the member states.
He also said that Poland wants the agreement to include a requirement that imported products comply with EU production standards.
