New GM law takes effect in Ukraine

A law regulating genetic engineering activities and the placing of GM organisms and related products on the market took effect in Ukraine on September 16, 2026. The legislation introduces new rules governing the registration, cultivation, labeling and traceability of genetically modified products.

Only GM organisms and their sources included in the open State Register may now be legally grown and used in Ukraine. Market participants must declare and report their activities involving GM organisms. The law also establishes the registration procedure, from submitting an application to the possible withdrawal of authorization.

Products containing GM ingredients or produced using GM raw materials must be labeled accordingly. The requirements apply not only to food products but also to seeds and feed. Separate traceability rules will make it possible to identify the origin of products at every stage of their circulation.

Open-field trials of GM crops require prior notification of the relevant state authorities, including information about the trial location. The law also regulates the coexistence of GM crops with conventional and organic crops to minimize risks to neighboring farms.

Violations are subject to fines ranging from 15 to 20 minimum wages for companies and from seven to 10 minimum wages for individual entrepreneurs. The illegal sale of GM products may result in a penalty equal to 100% of the consignment’s value but no less than UAH 100 thsd, while the products may be seized or destroyed. The new rules are also intended to bring Ukrainian GM legislation closer to EU standards.
