Ukraine approves mechanism for determining origin of soybeans and rapeseed for export

On October 3, the Cabinet of Ministers of Ukraine approved a procedure for determining the origin of soybeans and rapeseed to exempt them from the 10% export duty. From now on, origin confirmation will be based on expert opinions issued by the Chamber of Commerce and Industry (CCI), which will be submitted to customs authorities.
According to the resolution, agricultural producers are required to register their sown areas and harvests in the State Agrarian Register (DAR), create a personal account on the CCI website, upload the necessary documents, and submit an electronic application. The review of such applications will take one to two days, after which the farmer will receive an expert opinion.
It has been established that the declared yield cannot exceed 3.5 tons per hectare, and the total volume must correspond to actual production. This means that the certificate cannot cover larger quantities than those physically harvested.
CCI conclusions will be issued for each individual batch of products. Submission of documents for customs clearance is allowed only after the harvest has been collected, although farmers and cooperatives may conclude forward contracts. This mechanism is expected to ensure transparency and consistency between declared and actual volumes.
Separately, the government instructed the Ministry of Economy, Environment and Agriculture to organize monitoring of compliance between data in CCI certificates and information in the DAR, taking into account actual exports carried out under the reduced duty. The State Customs Service will provide the ministry with monthly reports on export volumes benefiting from the exemption and the expert opinions submitted. In addition, the CCI was recommended to maintain strict control over the issuance of certificates to prevent duplication of documents for the same land plots, and to report monthly on the expert opinions issued.
The resolution comes into effect upon publication.
At the same time, the issue of refunding already paid export duties is not regulated by the adopted procedure. Deputy Minister of Economy Taras Vysotskyi noted earlier that such refunds would only be possible after amendments to the legislation, which are currently under consideration in parliament.
